Some of you may wonder whether your case should or should not go to trial. That is very fact specific. It depends whether a viable defense can be raised, by example, a rising blood alcohol, or the fact that the chemical test is inaccurate. It also depends upon other facts of your case. Many times, the driving is not bad. Meaning, the driver responds appropriately and immediately to the overhead lights. That’s circumstantial evidence the driver is not impaired at that moment in time and that the subsequent chemical test did not measure the blood alcohol level at that critical time of driving. There are defenses to many cases. Whether a case should go to trial or not depends, in great part, on the specific facts of the given arrest.
